Short Sale
A short sale occurs when a mortgage lender agrees to accept less than the outstanding loan amount owed to satisfy the seller's loan securing the real estate. A short sale allows both the lender and the distressed property owner avoid foreclosure by selling the property at a loss. If your home is upside down (you owe more than the property is worth) and you are in financial hardship, we can potentially help get you out of your situation without having to file for bankruptcy.
Short sale transactions are complicated and much more time consuming than an average real estate sale, making it important to retain an experienced real estate attorney to oversee and negotiate the transaction. A short sale is initiated by a distressed seller listing the property for sale at the current market price, sometimes at a much lower amount than what the seller may have originally paid for the property. There then must be an offer to purchase by a bona fide purchaser for the property, before the short sale offer can be submitted to your lender. Our experienced real estate attorneys can help sellers throughout the short sale process deal and negotiate with their lenders and draft sales contracts which include the conditions of the short sale.
